Terms and Conditions

Welcome to Gingersnaps’ website. The Gingersnaps Singapore (“Gingersnaps”) online store is owned and operated under the registered entity Global Resource Group Pte Ltd, with Company registration 200510405G (the “Company”) incorporated under the laws of Singapore.  We are committed to make your shopping experience as fuss-free and enjoyable as much as possible. These terms and conditions (the "T&Cs") apply to sg.gingersnaps.com.ph (the "Website") and form the terms and conditions on which we supply products and services to you. Please read through the T&Cs prior to using the Website.  Your continued use of the Website, platform or any purchase of our products in any one of our stores constitutes your acknowledgement and understanding of, and agreement with, our T&Cs and Privacy Policy.  

If we need to contact you for service-related matters, we will do so by telephone or by writing to you at the contact number or email address you have provided to us in your order. "Writing" or "written" in these T&Cs includes emails.  

The failure by us to exercise or enforce any right or provision of these T&Cs shall not constitute a waiver of such right or provision.  These T&Cs and any rules and policies posted by us on this Website constitutes the entire agreement and understanding between you and us and govern your use of the Website, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, prior versions of the T&Cs).  Any ambiguities in the interpretation of these T&Cs shall not be construed against the drafting party.

1) Access and Use of the Website

As a condition of your access to and/or use of the Website, you warrant that:-
  1. all information supplied by you on the Website is accurate, current and complete;
  2. you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site;
  3. you shall be solely responsible for your access to and/or use of the Website;
  4. you have the legal capacity and you agree to comply with these T&Cs;
  5. you will not use the Website for any illegal or unauthorized purpose;
  6. your use of the Website will not violate any applicable law or regulation; and
  7. you will not modify, copy, transmit, reproduce, publish or distribute any part of the Website, products and imaged contained herein without the Company’s prior consent.  All content included on the Website is the exclusive property of the Company.
We reserve the right to refuse any order placed with us or service to anyone for any reason at any time.  If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Website (or any portion thereof).

2) Account Registration

You will be prompted to register for an account, and provide your particulars during the purchasing process.  You agree to provide current, complete and accurate purchase and account information for all purchases made at our Website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.  You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.  We reserve the right to disable any user account at any time, if in our opinion you have failed to comply with any of the provisions of these T&Cs.  We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.  Please write to hello@gingersnaps.com.sg immediately if you discover any unauthorized use of your account.

3) Product Information and Pricing

  1. Our prices are shown in Singapore dollars.  Prices for all products are subject to change.  We make every effort to ensure that details, descriptions and prices displayed on the site are as accurate as possible. In the event that we discover errors in the price and information displayed and you have ordered the items, we will inform you accordingly. We shall not be liable to you or to any third-party for any modification or price change in our products or services.
  2. We are a Goods and Services Tax (“GST”) registered company.  Hence, all purchases are subject to Singapore GST.
  3. We make every effort to display as accurately as possible the colours, features, specifications, and details of the products available on the Website. However, we do not guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors.  In addition, your electronic display may not accurately reflect the actual colours and details of the products.
  4. The price payable by you for the product shall be the price of the product listed for sale as stated on the Website at the time your order is transmitted to us, and any applicable taxes. All prices are subject to taxes, unless otherwise stated. We reserve the right to amend the price of any product at any time without giving reason or prior notice.
  5. Prices displayed excludes shipping charges. Shipping charges will be reflected upon check out of your orders.
  6. All products are subject to availability. Our products are available in limited quantities and are subject to return or exchange only according to our Return and Exchange Policy.  We reserve the right to discontinue any products at any time for any reason.

4) Order Acceptance and Payment

  1. All orders are subject to acceptance and availability. Items added to your digital shopping bag are not reserved. Our acceptance of your order will only take place when full payment is made, and a payment confirmation email is sent to your registered email address with us, at which point a sales contract will come into existence. Orders placed but not paid for in full will be cancelled if payment recovery is not made.  In the event that we are unable to process your order, due to reasons such as, but not limited to, inability to obtain an authorization for payment from you due to any technical error, product ordered is out of stock or defective, or error in the price or description of the product, Gingersnaps shall reserve the right not to accept your order without penalty on our part.
  2. Upon check out of your order, you will be directed to our payment page. Please make payment immediately to secure your order.  Orders will not be confirmed if you leave the payment gateway page without completing the payment, and may result in items in your shopping bag being out of stock.
  3. For Singapore based customers with a registered Paynow account, payment can be made via Paynow transfer by scanning our corporate Paynow QR code when you checkout by selecting "Bank Transfer".
  4.  We accept all major credit cards through Stripes and Paypal.  You acknowledge that the credit/ debit card that is being used belongs to you or that you have been specifically authorized by the owner to use it.
  5. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Website. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.  
  6. You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping charges, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order.
  7. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.
  8. We reserve the right to refuse any order placed through the Website.  We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order, or to limit the sales of our products to any person, geographic region or jurisdiction.  These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

5) Gift Boxes

Our signature gift boxes are available for purchases made online.  Click on ‘Gift Box’ on the product page, or on the shopping bag page, and indicate the number of gift boxes required. You can also add a little extra love to your gift recipient with a personalised message and we will print a gift card for you.  A small fee of SGD 2 applies for each gift box. Each gift box can hold up to four clothing items. Please note that we are unable to pack bulky items into the gift boxes. We will send you an email if we are unable to fit your item(s) into the gift box.

6) Returns and Exchanges Policy

All sales are final and no refunds will be issued.  Please review our Returns and Exchanges Policy posted on the Website prior to making any purchases.

7) Promotion Voucher Codes

Please input the promotional voucher code before check out to apply the discount. No refunds will be made for orders where voucher codes are not entered at point of purchase.  Promotional codes are non-transferable and have no cash value. They may or may not be used in conjunction with other promotions or offers, and must be redeemed by the expiry date as indicated. In the event that a customer receives additional discounts due to an erroneous voucher code which does not reflect the intended marketing promotion mechanics, Gingersnaps reserves the right to request for collection of the remainder payment from the customer before fulfilling the order without penalty on our part. Please note that in the event that a store credit is requested for reasons that are eligible based on our return policy, store credits will take into account the discount mechanics applied to your order.

8) Store Credits

Store credits have no cash value. Each store credit can only be used once, within 6 months from the date of issue, and any excess amount will not be refunded. Orders placed using a return store credit are not applicable for another return/exchange. Store credits are strictly non-refundable, non-extendible and non-transferable.

9) Personal Information

Your submission of personal information through this Website is governed by our Privacy Policy.

10) User Reviews and Feedback

We may provide you areas on the Website and on our Social Networking Accounts and Pages, to leave reviews or ratings. When posting a review, you must comply with the following criteria:
  1. you should have firsthand experience with the product being reviewed;
  2. your reviews should not contain offensive profanity, or abusive, racist, offensive, or hate language;
  3. your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability;
  4. your reviews should not contain references to illegal activity;
  5. you should not be affiliated with competitors if posting negative reviews;
  6. you should not make any conclusions as to the legality of conduct;
  7. you may not post any false or misleading statements;
  8. you may not organize a campaign encouraging others to post reviews, whether positive or negative.
We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or partners. We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully-paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to reviews.

We reserve the right to change the content or material of this Website at any time.  While we make every effort to ensure accuracy of information on the Website, we are not responsible if information made available on this Website is not accurate, complete or current, and we are under no obligation to update the Website.  Occasionally, there may be information on the Website that contains typographical errors, omissions or inaccuracies that may relate to product description, pricing, availability, promotions, offers, shipping charges, and transit times.  We reserve the right to correct such errors, omissions or inaccuracies and to change or update the information on the Website or cancel orders at any time without prior notice.

The Website may contain links to other websites ("Third-Party Websites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties ("Third-Party Content").  We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party content or websites, or for any other materials, products, or services of third-parties.  Inclusion of, linking to, or permitting the use or installation of any Third-Party Websites or any Third-Party Content does not imply approval or endorsement thereof by us.  We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Website, any hyperlinked website, or any website or mobile application featured in any banner or other advertising, and we will not be a party to or in any way be responsible for monitoring any transaction between you and any third-party providers of products or services.  As with the purchase of a product or service through any medium or in any environment, you should use your best judgement and exercise caution where appropriate.  We take no responsibility whatsoever in relation to purchases you make through Third-Party Websites which are exclusively between you and the applicable third party. All content included on this website is the exclusive property of Global Resource Group Pte Ltd. You may not modify, copy, distribute, transmit, reproduce, publish, and create derivative works in any form from the products and images contained within this website without seeking a licensing arrangement.  You may not use or appear to in any way be affiliated to this website or its content to further any commercial purpose without any written permission or license obtained from Global Resource Group Pte Ltd.

15) Disclaimer of Warranties

18) Severability

If any provision or part of a provision of these T&Cs is determined to be unlawful, void or unenforceable, such provision or part of a provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these T&Cs, and such determination shall not affect the validity and enforceability of any remaining provisions.

19) Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.  The T&Cs are effective unless and until terminated by either you or us. You may terminate the T&Cs at any time by notifying us, and when you cease using our Website. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of the T&Cs, we may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Website (or any part thereof).

These T&Cs and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Singapore.
